The rules and guidelines for using Brainy

These Terms of Service govern your use of Brainy (brainy.ink) — a platform for creators to showcase work, get featured, and access opportunities.
Simple version: You keep ownership of your work, we feature it with credit, you can opt out anytime, and we all play fair.
By using Brainy (brainy.ink), you agree to these Terms of Service. If you don't agree, please don't use the platform.
We may update these terms. If we make significant changes, we'll notify you via email (if you're on the whitelist). Continued use means you accept the updated terms.
You must be at least 18 years old (or the age of majority in your jurisdiction) to use Brainy. By using the service, you represent that you meet this requirement.
You're responsible for maintaining the security of your account credentials. Notify us immediately if you suspect unauthorized access at hi@brainy.ink.
You retain full ownership of all content you submit to Brainy. You never give up your intellectual property rights. We only get permission to display, feature, and promote your work as part of our service.
By submitting content, you grant Brainy a non-exclusive, worldwide license to: display your work on our platform, feature it with creator credit, optimize format for engagement, and promote it on social media. You can revoke this license anytime by requesting removal via our opt-out page.
Your content must: be original or properly licensed, not infringe on others' rights, comply with applicable laws, not contain malware or harmful code, and follow our community guidelines (when published).
Current pricing is displayed at checkout. Whitelist signup is free. Premium features (like promotional placement) require payment. Prices may change with notice.
Payments are processed securely via Stripe. We never store your full credit card information. You agree to provide accurate payment information.
Promotional placements are generally non-refundable once scheduled or published. Contact hi@brainy.ink if you believe you're entitled to a refund — we review each case individually.
Virtual currency (Brainy Coins) has no cash value. Coins are not refundable once purchased but can be used for platform features. Coin balances don't expire unless your account is deleted.
You may use Brainy to: showcase your creative work, discover opportunities, connect with clients, and participate in the community. You agree not to: spam, harass, or abuse others; violate laws or regulations; attempt to hack or disrupt services; or impersonate others.
Featured placements are curated, not guaranteed. We may feature work based on quality, fit, and community value. We provide clear credit and route opportunities to creators when possible.
You can opt out of: email communications, content featuring, or delete your account entirely at any time via our opt-out page or by emailing hi@brainy.ink.
You may not: submit content you don't own, use bots or automation, scrape or harvest data, resell Brainy services, manipulate metrics or engagement, infringe on intellectual property, or engage in fraudulent activity.
Violations may result in: content removal, account suspension, permanent ban, or legal action if necessary. We'll provide notice when possible, except for severe violations.
Brainy is provided "as is" without warranties of any kind. We don't guarantee: uninterrupted service, error-free operation, specific results or outcomes, or compatibility with all devices.
We don't guarantee: that your content will be featured, specific traffic or engagement results, client opportunities, or revenue from the platform. Results vary based on content quality and market demand.
To the maximum extent permitted by law, Brainy is not liable for: indirect, incidental, or consequential damages; lost profits or opportunities; data loss; or damages exceeding the amount you paid us in the past 12 months.
We integrate with third-party services (Stripe, ClickUp, Instagram, etc.). We're not responsible for their actions, policies, or service interruptions. Each has their own terms of service.
These terms are governed by the laws of the Republic of Estonia and the European Union. Any disputes will be resolved in accordance with Estonian law in the courts of Estonia, though we prefer to resolve issues amicably first through direct communication.
If any provision is found unenforceable, the remaining terms stay in effect.
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Brainy regarding your use of the service.
